Cutkosky, who portrays the second youngest Gallagher kid on Showtime’s hit series “Shameless,” was charged with one count of a misdemeanor DUI this week stemming from an arrest on Nov. 2, TMZ reported.
The 18-year-old reportedly smelled of marijuana and had admitted to officers that he was smoking earlier in the evening at the time he was pulled over in Los Angeles around 10: 30 p.m.
Cutkosky was stopped after reportedly straddling traffic lines.
He spent that night celebrating his girlfriend’s birthday. Both Cutkosky and his girlfriend, Brielle Barbusca, shared photos of the celebration to social media just hours before the actor’s arrest.
Law enforcement sources told TMZ that he faces up to six months in jail, a $1,000 fine and a possible loss of license if convicted.
He was also charged with traffic violations from the night of his arrest.
Cutkosky’s character in the series has a rebellious streak and at one point found himself in a juvenile detention center.
William H. Macy, who plays Cutkosky’s deadbeat dad on the series, defended the teen, declaring it is difficult to grow up in the spotlight.
“He’s great. He’s a great kid,” Macy told PEOPLE Now. “I’m gonna kick him in the butt when I see him, because I was there when he was trying to pick out which car to get…” Macy shared.
“I did tell him, ‘Don’t get a hot car because trust me, it’s hard to keep your foot off the accelerator, and you’re young and dumb and the cops are looking for you,'” he continued. “I lectured him about all that stuff, but people make mistakes, and nobody got hurt.”
Cutkosky was driving an orange BMW when he was arrested.
