DPP wants Swazuri’s bond cancelled over witness interference, intimidation

, NAIROBI, Kenya, Feb 12 – Director of Public Prosecutions Noordin Haji is now seeking cancelation of National Land Commission Chairman Muhammad Swazuri’s bond terms over claims of witness interference and intimidation.

Under a certificate of urgency filed Tuesday before the High Court Anti-Corruption Division, the DPP is also urging the court to have Swazuri barred from setting foot at the commission’s premises.

In a sworn affidavit by prosecuting counsel Esther Njuguna, Haji claims that Swazuri has more than once engaged in clear acts of interference with witnesses in disobedience of court orders.

“The conduct of the respondent which includes interference with witnesses and documentary exhibits should warrant the cancelation of his bail terms,” states Njuguna.

“He has continued to engage in conduct that compromises the interests of NLC in outright conspiracy with known individuals,” adds the Prosecuting Counsel.

Haji has implored the court to take judicial notice that soon after he was freed on bail and allowed to access his office, “it was broken into with material documents and evidence stolen”.

He argues that cancellation of Swazuri’s bail terms will not jeopardize operations of NLC since his continued access to the commission offices has paralysed its operations.

“During the pendency of the graft case unless accompanied by an EACC or police officer he should not set foot since his conduct has proved to be extremely detrimental to NLC and threatens public interest.”
